Terms of Service

Sirium.net provides World Wide Web page hosting and related services (e.g. email). Sirium.net reserves the right to suspend or cancel a customer's access to any or all services provided by Sirium.net when Sirium.net decides that the account has been inappropriately used or otherwise.

Server use
Personal (non-reseller) accounts are to be used by the primary owner only. Personal account holders are not permitted resell, store or give away web-hosting services of their own web site to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads.

Account holders are not to use their web space as backup storage. There are other services much more suited for this use.

Sirium.net reserves the right to refuse service and/or access to its servers to anyone.

Sirium.net do not allow any of the following (but not limited to) content to be stored on its servers:

  • Copyrighted Material - This includes copyrighted commercial audio, video, image, or music files, and any material in violation of any UK, European or USA law. Exceptions to this is granted to the account holder where they are the copyright holder, or have the copyright holder's permission to do so.
  • Illegal Adult Material - Includes pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of Sirium.net.
  • Warez - Includes pirated software, ROMs, emulators, phreaking, hacking/cracking, password cracking, IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.

High Resource User Policy
Resources include but are not limited to; disk space, data transfer (bandwidth) and/or processor (CPU) utilisation.

Sirium.net may implement the following policy to its sole discretion:

When a web site is found to be monopolizing the resources available Sirium.net reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. Customers may be offered an option whereby Sirium.net continues hosting the web site for an additional fee.

Payment Policies
All accounts are set up on a prepay basis. Although Sirium.net reserves the right to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year or month following the date the account was established.

No bills or invoices will be sent by regular postal mail. All invoices will be sent directly to customers via email.

Contact details
It is your responsibility to keep your contact details up to date. If you do not keep us apprised of changes in your contact details, we will not be able to inform you of service changes or problems with your web site, or be able to invoice you correctly. This could mean your account being suspended and eventually deleted without warning.

Security

Sirium.net reserves the right to audit the server and to remove any file(s) and/or any scripts that compromises server security without notice. Such files include ".rhosts", poorly written scripted files (such as PHP and PERL scripts), or web based command line tools such as "commandliner".

Payment Options

PayPal
Sirium.net accepts payments via a Paypal account.

Credit/Debit Cards:
Sirium.net accepts MasterCard, Visa via Paypal (check their relevant web sites for payment details)

Cheques:
Sirium.net accepts personal cheques drawn on UK banks or building societies only. If your cheque is returned by the bank as unpaid for any reason, you will be liable for a "returned cheque" charge of £25.

Payments must be made within a reasonable period of your receiving an invoice or payment request. Failure to do so will result in your account being suspended and eventually deleted. We endevour to inform you beforehand if this happens.

Without prejudice to our other rights and remedies under this Agreement, if any sum payable is not paid on or before the due date, we shall be entitled forthwith to suspend the provision of Services to you.

Suspension and Termination
If you fail to pay any sums due to us as they fall due, we may suspend the Services and/or terminate this Agreement forthwith without notice to you.

If you break any of these terms and conditions we may suspend the Services and/or terminate this Agreement forthwith without notice to you.

If you are a company and you go into insolvent liquidation or suffer the appointment of an administrator or administrative receiver or enter into a voluntary arrangement with your creditors, we shall be entitled to suspend the Services and/or terminate this Agreement forthwith without notice to you.

No refunds will be made for Services suspended in accordance with three paragraphs above.

We reserve the right to suspend the Services and/or terminate this Agreement at any time. In the event of this, you will be entitled pro rata refund based upon the remaining period of membership (a refund only applies when Sirium.net cancels this agreement with you for reasons other than improper use of its services, failure of payment by you as outlined in this agreement).

You may cancel the Services at any time.

During the first 30 days of Services, You are entitled to a complete refund of all fees paid with the exclusion of domain name registration and data transfer fees should You decide to cancel the Services. You will not be entitled to a refund on this basis if you have previously had an account with Sirium.net. No full refunds or pro rata refunds will be made after the first 30 days of service should You decide to cancel the Services.

Where payments have been made via a NoChex or PayPal account, refunds will be made back to the same account, or via a personal cheque. We may request proof of your identity before refunding any monies.

On termination of this Agreement or suspension of the Services we shall be entitled immediately to block your Web Site and to remove all data located on it.

Termination and suspension periods
In the case of non payment, Sirium.net reserves the right to suspend accounts/services 5 days after the relevant invoice due date.

Sirium.net reserves the right to charge a late fee to unpaid invoices.

Sirium.net will allow 30 days for an invoice to be paid (this is 30 days after the invoice due date), if it is still not paid after this period then Sirium.net will terminate the account/services, which includes deletion of all data, configurations and any backups. Sirium.net will not be held liable for any data lost.

Cancellation
Please note the following cancellation procedures for the service type

Shared hosting and domain names
Please notify us of your intent to cancel by opening a support ticket to sales at least 48 hours before the upcoming invoice due date.

VPS
Please notify us of your intent to cancel by opening a support ticket to sales at least 72 hours before the upcoming invoice due date.

Failure to inform Sirium.net of your intent to cancel, or if you let the service lapse, may result in Sirium.net using a third party to recover due invoices, and may also incur a further charge to administer.

Resellers
It is the reseller's responsibility to support their customers. Sirium.net will not normally provide support directly to a reseller's customer unless requested to by the reseller - in such circumstances, the reseller will be billed an hourly fee for the time taken to help their customer.

Sirium.net reserves the right to suspend an account resold by a reseller of Sirium.net's services if the account is in violation of these T&Cs, or if the reseller fails to pay due invoices.

In normal circumstances, Sirium.net will not contact a reseller's customers directly without the reseller's consent. However, Sirium.net reserves the right to contact the reseller's customers if the reseller fails to keep their payments up to date and the reseller's account is suspended, and is likely to be terminated. In this case, the reseller's customers will be offered a transfer directly to Sirium.net, or another Sirium.net reseller.

Indemnification
The customer agrees that they shall defend, indemnify, save and hold Sirium.net harmless from any and all demands, liabilities, losses, costs and claims, including reasonable solicitor/lawyer/attorney fees asserted against Sirium.net, its agents, its customers, officers and any employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. The customer agrees to defend, indemnify and hold harmless Sirium.net against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Sirium.net's server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from Sirium.net's server.

Disclaimer
Sirium.net will not be responsible for any damages your business may suffer. Sirium.net makes no warranties of any kind, expressed or implied for services we provide. Sirium.net disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by Sirium.net and any of its employees. Sirium.net reserves the right to revise its policies at any time.

30 Day money back guarantee
Sirium.net offers a 30 day money back guarantee where the customer can claim back their hosting fee if, for some reason, they are unhappy with the service received within those 30 days. This offer is only valid for new customers and they must claim at least no later than the 30th day after their account was opened.

The money back guarantee will be deemed void if the account has been misused or otherwise used to abuse Sirium.net's or other's servers and/or services.

Account backups
Accounts hosted on Sirium.net's servers, unless otherwise requested, are backed up automatically over night to a third party off-site storage server. These backups can be accessed via the cPremote (where available, please ask if it's not in your cPanel account) control panel in your cPanel account, or can be requested by submitting a ticket to support.

Please be aware though, the backup system and backups themselves are not guaranteed and should not be relied upon in place of your own backups. It is not guaranteed that backups will be available, and it is not guaranteed that backups will be usable and/or free of errors caused by problems such as file corruption, for example.

You should at the very least keep a copy of your site files and a copy of any dynamic data such as from mySQL databases, etc. You can create and download full or partial backups at any time from your cPanel account.

We also reserve the right to not backup sites that cause excessive network traffic (those with a large amount of data).

Updates
We (Sirium.net) reserves the right to update these Terms and Conditions without prior notice. With this in mind, we ask that you check back often.
